Update on Dismissal of Suit by Forrester and Papdapolous

Last month, on the eve of trial, plaintiffs Michael Papadapolous and Scott Forrester dismissed their case against the KBOO Foundation "with prejudice" which means giving up their right to renew the same legal claims.  Previously,  the court had granted our motion to dismiss all claims against individual board members so all that remained of the case were claims against KBOO for refusing to agree to particular  membership list requests from 2008.

Attached here to this blog post is what our lawyer Scott Pratt was prepared to say about the case at trial.  If you are interested, it provides a good overview of the facts of the case and KBOO's position.

Additional documents from the case are online at http://kboo.fm/node/19744

Unfortunately, Michael and Scott pursued their (useless in my opinion) arguments up to the brink, rather than working with the organization to help us succeed.  But I think I can correctly say that the Board is happy to finally put the lawsuit behind us.
